These Terms and Conditions (“Terms”) govern your participation in our cooking classes, whether in-person or online (if applicable), and your use of our website, [insert website URL]. We offer cooking classes to teach culinary skills in a safe and professional environment.
2. Eligibility

Participants must be at least 18 years old to register for and attend classes, unless otherwise stated (e.g., classes designed for children with parental consent).

For classes involving children under 18, a parent or legal guardian must provide consent and supervise the child if required.

You must be physically capable of participating in cooking activities, which may involve standing for extended periods, using kitchen equipment, and handling food.
3. Registration and Payment

Registration: To attend a class, you must complete the registration process via our website or in person and provide accurate personal information as outlined in our Privacy Policy.

Payment: Full payment is required at the time of registration to secure your spot unless otherwise agreed. We accept credit card payments, which are processed securely through our third-party payment provider.

Pricing: Class fees are as advertised on our website or in promotional materials. Prices include shipping and VAT but exclude.

Confirmation: Upon successful registration and payment, you will receive a confirmation email with details.
4. Cancellation and Refund Policy

Cancellations made at least 7 days before the class start date are eligible for a full refund, less a 10% administrative fee.

Cancellations made less than 7 days before the class are not refundable, but at our discretion, they may be transferred to another class of equal value, subject to availability.

No refunds or transfers are available for no-shows or cancellations on the class day.

We reserve the right to cancel or reschedule a class due to insufficient registrations, instructor unavailability, or unforeseen circumstances (e.g., power outages or emergencies).

If we cancel a class, you will receive a full refund or the option to transfer to another class of your choice, subject to availability.

We are not liable for any additional costs you incur (e.g., travel or accommodation) due to cancellations or rescheduling.

5. Class Conduct and Safety

Behaviour: You must act respectfully toward instructors, staff, and other participants. Disruptive, abusive, or unsafe behaviour may result in your removal from the class without a refund.

Safety Rules: You must follow all safety instructions provided by instructors, including proper use of kitchen equipment (e.g., knives, ovens) and hygiene practices.

Allergies and Dietary Requirements: You must inform us of any food allergies or dietary restrictions at the time of registration. While we strive to accommodate requests, we cannot guarantee an allergen-free environment.

Health: Do not attend a class if you have a contagious illness (e.g., flu or COVID-19). Contact us to discuss rescheduling options.

Personal Belongings: You are responsible for your personal belongings during classes. We are not liable for loss or damage to your property.
6. Liability for Property Damages

Participant Responsibility: You are responsible for any damage you cause to our property, equipment, or facilities (e.g., kitchen appliances, utensils, or premises) during a class, whether due to negligence, misuse, or intentional acts.

No Liability for School: Stimulus, its owners, employees, or agents are not responsible for any damages to the property caused by participants. You agree to indemnify us for any costs, repairs, or replacements arising from such damages.

Inspection: We may inspect equipment and facilities before and after classes to assess any damage. If damage is attributed to you, we will notify you in writing and provide an invoice for repair or replacement costs, payable within 7 days.
7. General Liability and Indemnity

Risk Acknowledgement: Cooking classes involve inherent risks, such as cuts, burns, or slips. By participating, you acknowledge and accept these risks.

Limitation of Liability: To the extent permitted by law, [Your Cooking School Name] is not liable for any injury, loss, or damage you suffer during a class, except where caused by our gross negligence or willful misconduct. Our liability is limited to the class fee you paid.

Indemnity: You agree to indemnify and hold us harmless against any claims, losses, or damages arising from your actions or breach of these Terms, including damage to property or injury to others.

Consumer Protection Act: Nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008, including your right to safe and quality services.
8. Intellectual Property

9. Photography and Media

We may take photographs or videos during classes for promotional purposes. By participating in our brands, you consent to your image being used in our marketing materials, unless you notify us in writing at debbie@yoloonline.co.za or debbie@deborahonline.co.za to opt out.

You may not record or photograph classes without our prior written consent.
10. Privacy and Personal Information

11. Force Majeure
We are not liable for classes not delivered due to events beyond our control, including, but not limited to, natural disasters, power outages, government restrictions, or strikes. In such cases, we will offer rescheduling or refunds as outlined in Section 4.

Due to operational needs, we may modify class schedules, instructors, or content. We will notify you of significant changes in advance.

We may update these Terms at any time. The latest version will be posted on our website, and continued class participation constitutes acceptance of the updated Terms. Significant changes will be communicated via email or website notice.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of South Africa. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of South Africa.
